TOURNAMENT REGISTRATION
Section I—Tournament Registration and Entry
- As used herein, Hardbat Classic LLC (“HBC”) is a Delaware limited liability company. HBC reserves the right to refuse anyone entry into the Tournament, as defined below, in its sole and absolute discretion.
- Entry into the 2009 Hardbat Classic Tournament (herein the “Tournament” refers to the ping pong tournament scheduled from June 26, 2009 through June 28, 2009) is open to persons of all ages who are U.S. residents and that HBC, acting in its sole and absolute discretion, deems appropriate. The Tournament will be recorded in an audiovisual format for use as HBC, its affiliates, partners and assigns desire (the “Program”).
- Registration for the Tournament can be done by following the instructions at http://www.hardbatclassic.com. The entry fee is a non-refundable one hundred dollars ($100.00) payable through Google Check-out, as per the online instructions. The number of entrants will be limited to 1,024 people. If space is available, Participants may register in person at the Venetian Hotel on June 26, 2009 up to 4:30 pm (PST). All Participants will need to present their current valid picture identification (passport, driver’s license, student ID, state or military identification card) acceptable to HBC, in person at the Venetian Hotel to complete registration and to obtain his or her table assignment. The Registration form for anyone under the age of 18 must also be signed by the Registrant’s parent or guardian AND said parent or guardian must be present at the Tournament and sign the registration forms in person. If a Participant is not a U.S. citizen, a current passport, consular identification or alien registration card is required.
- Third-party registrations for Participants are not permitted unless submitted by official HBC sponsors, official HBC promotional partners, or official HBC product licensees.
- Participants may also enter the Tournament by qualifying through local tournaments organized by Bud Light distributors.
- Participants are responsible for payment of any and all costs for their own transportation, lodging, food, etc. associated with their participation in the Tournament.
- Employees of HBC, its members, affiliates and licensees, Las Vegas Sands Corp., ESPN Inc., Anheuser-Busch Inc., Killerspin L.L.C., Empire Entertainment Inc., CRG Events and any other sponsors and each of their respective parents, subsidiaries, affiliates, owned, operated or managed properties, contractors hired for the operation of the Tournament or parent companies and immediate family members of such employees are not eligible to play in the Tournament. Immediate family members are defined as: spouse, children and any relative or other person residing in the employee’s place of residence.
- Individuals who are excluded from casino facilities, either through a government program or by their own request, are not eligible.
- No substitutes or transfers will be permitted. HBC reserves the right to accommodate players based on special needs.
- By submitting a registration form to HBC for registration in and/or participation in the Tournament, such persons agree to all of the rules stated herein.
- The ability to register online as described in these rules is void where prohibited or in any way restricted by law.
- Entries will be retained for record-keeping purposes in accordance with local legal requirements.
Section II—Tournament Rules/Scheduling
- Participants must read and agree to the “Hardbat Classic Rules” found at http://www.hardbatclassic.com/rules.
- The Tournament times are approximate. HBC reserves the right to change the Tournament times in its sole and absolute discretion.
- HBC is not responsible for electronic transmission errors or delays resulting in omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical hardware, software, or telephone failures of any kind, lost or unavailable connections, fraud, incomplete, garbled, or delayed computer transmissions, whether caused by HBC, users, or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error that may occur in the processing of submissions, any of which may limit, restrict, or prevent a Participant’s ability to participate in the Tournament.
- If for any reason, including any Force Majeure event, technical failures or any other causes within or beyond HBC’s control that affect the administration, security, location or holding of the Tournament, HBC reserves the right in its sole discretion, to cancel, terminate, modify or suspend the Tournament.
- Neither HBC, the sponsors, or the Venetian Hotel is responsible for injuries or losses arising or resulting from participation in the Tournament and is not liable for any acts or omissions by employees, whether negligent or willful, in the conduct of the Tournament and is not liable in the event of any equipment or software malfunction.
Section III—Participant’s Name, Likeness and Image
- Each Participant hereby agrees, in consideration of his/her participation in the Tournament, to grant HBC the following irrevocable rights throughout the universe in perpetuity:
- the right for HBC's to film, tape, photograph and/or record for use in and in connection with the Program (including, without limitation, whether Participant is aware or unaware of the filming, taping, photographing or recording) and agrees to cooperate fully with HBC in such activities. Participant acknowledges and agrees that HBC will be the sole and exclusive owner of all rights and material filmed, taped, photographed and/or recorded pursuant to the terms hereof. In addition, Participant hereby grants to HBC the unconditional right throughout the universe in perpetuity to use, simulate or portray (and to authorize others to do so) or to refrain from using, simulating or portraying, Participant’s name, likeness (whether photographic or otherwise), voice, personality, personal identification, personal experiences, life story, biographical data, incidents, situations and events which heretofore occurred or hereafter occur, including without limitation the right to use, or to authorize others to use any of the foregoing in or in connection with the Program (or any episode or portion thereof) and the advertising, promoting or publicizing of the Program or any Program episode by HBC, any network broadcasting the Program, its operations, activities or programming services and in connection with any merchandise, tie-in, sponsor, product, or service of any kind by HBC, the network, or any the network’s programming services, and in any other manner whatsoever as HBC may elect in its sole discretion (including, but not limited to, exploitation on the Internet, wireless Internet, MMS and SMS messaging). Participant understands that HBC does not have any obligation to exploit any of the rights granted herein.
- the unconditional right throughout the universe in perpetuity to distribute, exhibit, advertise, promote and otherwise use in any manner whatsoever, and by any and all means and media, whether now known or hereafter devised, including, but not limited to, the Internet, wireless Internet, MMS and SMS messaging, the Program and/or any Program episode or any portion thereof including, without limitation, outtakes, behind-the-scenes footage and/or footage not used in any episode of the Program.
- Participants are to dress appropriately for the Tournament, which will be a televised event. Participants may not wear clothing apparel, hats, temporary tattoos, adhesive strips for the skin, and “band-aids” with logos or promotional language. HBC reserves the right at all time to impose a ban on any apparel deemed objectionable by HBC, in its sole discretion.
- Prior to playing in the Tournament, each Participant, and if a minor the Participant’s parent or guardian, must execute a Player Release Form. Failure to do so will subject the Participant to immediate disqualification and the Participant will forfeit all entry fees.
Section IV—Participant Conduct
- All Participants are expected to behave with civility and courtesy toward other Participants, the Tournament officials, employees of the Venetian Hotel and the audience. Failure to act in the manner can subject the offending Participant to immediate disqualification at HBC’s sole discretion.
- Any Participant found to have engaged in or attempted to engage in any act that HBC or any Tournament officials believe in their sole and absolute discretion, compromises or could compromise the competitive integrity of the Tournament will be subject to immediate disqualification at HBC’s sole discretion.
- Participants will not be allowed to carry mobile, cellular or other personal communication devices and such shall be prohibited form the Tournament floor.
Section V—Waiver of all Claims and Suits
- Participant agrees to hereby release, waive, discharge, and covenants not to sue HBC, its members, affiliates and licensees, Venetian Casino Resort LLC, Interface-Group Nevada LLC, Las Vegas Sands Corp. and their affiliates and subsidiaries, Anheuser-Busch Inc., ESPN Inc., Killerspin L.L.C., Empire Entertainment Inc., CRG Events and any other sponsors, advertisers, distributors, television stations, channels, or network broadcasting the Program and their respective parents, subsidiaries, licensees, shareholders, officers, directors, managing agents, employees, members, agents, attorneys, investors, affiliates organizations and entities, owned, operated or managed properties, contractors hired for the operation of the Tournament or parent companies (collectively “Releasees”) from all liability of whatever kind or nature, in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, for any and all present or future loss or damage, and any claims, liens, demands, causes or action, debts, liabilities, expenses including court costs and attorneys fees, suites or judgments therefrom (collectively hereinafter “Liability”) on account of any personal injury, injury to personal property, or resulting in death arising out of or related to the Tournament or releasing party’s presence in or upon the premises and facilities where the Tournament is taking place, including, but not limited to:
- Liability for any cause whatsoever, whether caused by the negligence of the Releasees or otherwise;
- Liability for negligent rescue operation or efforts by Releasees or other present on the premises;
- Liability related to the negligent use, development, implementation or enforcement of any rules, regulations, guidelines, procedures, or decisions by the Releasees and/or negligent operation and management by Releasees of the premises or facilities where the events are taking place;
- Liability regarding the issuance, selection, or distribution of prizes affiliated with the Tournament or regarding any negligence in establishing or enforcing any regulations for winning prizes.
- In particular, Participants agree that the Venetian Casino Resort, LLC, its parent, subsidiaries, affiliates, related companies and employees shall have no liability in connection with the Tournament including but not limited to the conduct of the Tournament, award of prizes and all related events.
- Participants acknowledges that this agreement is intended to be as complete of a waiver and release of any responsibility and liability to Participant, his/her personal representatives, heirs, and next of kin, for personal injuries, death, and/or property loss/damage sustained while in or upon the premises or facilities where the Tournament is taking place, whether or not Participant is actually actively participating in the Tournament or using any specific related equipment or services. Participant hereby further agrees and acknowledges that this agreement is intended to be as complete of a waiver and release as allowed by New York law, and that in no event will Participant have the right to seek and injunction or other equitable relief or to otherwise prevent the full exploitation of the Program and/or any of the rights granted hereunder.
Section VI—Hardbat Classic Rules
- Participants must acknowledge and agree to the Rules of the Hardbat Classic found at http://www.hardbatclassic.com/rules.
